Capone, Bert J. passed away on December 12, 2023, surrounded by his loving family. Bert is survived by his wife, Suzanne (Carter) Capone of Boston; his daughter, Christina (Capone) Nagler of Weston, her husband, Daniel, and their children; his sisters, Marilyn Capone and Phyllis (Capone) Cavan of Medfield; and his nieces and nephews.
A devoted grandfather in his retirement, Bert was a fierce construction and surety litigator during his 50-year career. Trying complex, high-profile construction failure cases nationally, Bert practiced at Boston’s top firms and lectured on risk management. When not in the courtroom, Bert found joy running Sherborn's winding roads, carving up the New Hampshire slopes, and powering his sport fisherman around the Cape and Islands.
A funeral Mass will be held at St. Julia Parish in Weston at 1pm on Tuesday, December 19. Family and friends are kindly invited. A private reception will follow. In lieu of flowers, expressions of sympathy may be made in Bert’s memory to the Kidney Research Center c/o Mass General Hospital Development Office, 125 Nashua Street, Suite 540, Boston, MA 02114.
